By accessing, browsing, or using the services provided by EYEGUAR (including our website, catalogue, visual materials, or direct communication), you agree to comply with and be bound by this Terms & Design Use Policy. If you do not agree, please do not access our website.
1. Confidentiality & Non-Disclosure
By accessing EYEGUAR’s content (including our private catalogue, pricing tiers, or unreleased collections), you agree not to share, reproduce, or disclose any part of it to third parties.
This obligation extends to retailers, agencies, manufacturers, or other designers.
EYEGUAR reserves the right to take legal action in cases of idea theft, design plagiarism, or IP infringement.
2. Intellectual Property & Design Ownership
All eyewear designs, 3D renders, product images, and conceptual sketches presented by EYEGUAR are original creations and legally protected.
Unauthorized reproduction, distribution, reverse engineering, or imitation—whether in full or in part—is strictly prohibited and will result in immediate legal action.
We retain full ownership of all intellectual property, even after a product has been licensed or sold in wholesale quantities, unless expressly stated otherwise in a signed contract.
3. Licensing & Wholesale Terms
All licensing partnerships are governed by individualized agreements based on region, product category, and usage rights.
Clients are not permitted to redistribute, modify, or claim ownership of any EYEGUAR designs outside the scope of the agreement.
In wholesale deals, clients are granted the right to resell EYEGUAR products, but not to modify or rebrand them without written permission.
4. Visual Previews & Render Disclaimer
All design visuals shown in the EYEGUAR catalogue — including 3D renders, enhanced previews, and AI-generated visuals — serve as conceptual representations only.
While every effort is made to maintain design integrity throughout the production process, minor differences in shape, material texture, color, or build may occur due to manufacturing limitations or refinements.
Only the final technical blueprint—shared and approved before sampling—constitutes the contractual basis for production quality.
5. Limitation of Liability
EYEGUAR shall not be held liable for any indirect, incidental, or consequential damages resulting from the use, resale, or licensing of our products.
While we take every measure to ensure excellence, minor deviations in color, form, or finish due to production variables or screen display differences are not grounds for liability.
6. Account Access & Security
Access to EYEGUAR's gated catalogue is granted through account creation. You are responsible for maintaining the confidentiality of your credentials. Misuse, unauthorized sharing, or access violations may result in account suspension or legal action.
7. Policy Updates
EYEGUAR reserves the right to update or revise these Terms & Design Use Policy at any time.
All changes will be posted on eyeguar.com/terms, and continued use of our services indicates acceptance of the revised terms.
8. Governing Law
This policy is governed by the laws of Switzerland. All disputes, claims, or violations arising under this policy will be resolved through the appropriate legal channels in Zurich.
